By using the services offered on or through www.putyourselfon.com (the "Put Yourself On Site") you are agreeing to the terms and conditions set forth below (the "Terms of Service" or "TOS"). We reserve the right, at our discretion, to change, modify, add or remove portions of these Terms of Service at any time. In addition to these Terms of Service, your use of the Put Yourself On Site and/or Services is governed by our Privacy Policy. You agree to Put Yourself On's collection, use and sharing of your information as set forth in the Privacy Policy, which may be amended by us from time to time in our discretion. When using particular Services (as defined below), you will be subject to any posted terms or guidelines applicable to such services, and any other terms or conditions applicable to Services provided by or in conjunction with any of Put Yourself On's content and service partners. The Privacy Policy and any posted terms or guidelines are hereby incorporated by reference into these Terms of Service.
If you do not understand and/or agree to these Terms of Service, please do not use the Put Yourself On Site or any Services (as defined below), and do not register to be a member of Put Yourself On. Do not use the Services until these questions and/or concerns of yours have been answered to your satisfaction, and you agree to abide by the terms and conditions of these Terms of Service.
The Put Yourself On Site offers a (free) multi-purpose service which allows you to, among other things, upload and share pictures, video files, audio tracks, blogs and status updates; send messages to other members; post comments, follow other members; and create and "groups" based around specific interests. Services may be offered by Put Yourself On itself, or by a third party partner/service provider. Unless otherwise stated, these Terms of Service apply to all Services. All content and additional or replacement services made available through the Put Yourself On Site that were not made available as of the "Last Updated" date above shall automatically be deemed to be part of the "Services" when first made available through the Put Yourself On Site.
You may access the Put Yourself On Site and use the Services for non-commercial purposes only. Use of the Services is void where prohibited. By accessing or otherwise using the Put Yourself On Site and/or Services, you are acknowledging and agreeing, and representing and warranting that (i) you have read, understand, and agree to be legally bound and to abide by these Terms of Service, just as if you had signed a written agreement; (ii) you have the right, authority and capacity to enter into this agreement and to abide by all the terms and conditions of these Terms of Service; and (iii) if you are acting on the behalf of any person or entity, you are authorized to act on behalf of such party.
You are responsible for your use of the Services, for any content you post to the Services, and for any consequences thereof. The Content you submit, post, or display will be able to be viewed by other users of the Services and through third party services and websites. You should only provide Content that you are comfortable sharing with others under these Terms.
You must be an individual of 13 years of age or older to register or use the Services. If you are not yet 13 years old, do not use the Services.
If you are at least 13 but not yet 18 years of age please have your parents or legal guardian(s) review these Terms of Service with you, discuss any questions you might have, and give you their permission to register and use the Services with both your and their full understanding of these Terms of Service. By using the Services, you are telling us that you and your parent or guardian have joined in this agreement.

Notice to parents/guardians: Most of the Put Yourself On Site contains user-generated-content, some of which may possibly contain material which may comprise nudity, violence, mature and/or suggestive subject matter. Put Yourself assumes no responsibility for filtering or monitoring the content viewed by its members; accordingly minor members' parents or guardians shall be solely responsible for filtering and/or monitoring their child's use of the Put Yourself Site and/or Services.
The Services that Put Yourself On provides are always evolving and the form and nature of the Services that Put Yourself On provides may change from time to time without prior notice to you. In addition, Put Yourself On may stop (permanently or temporarily) providing the Services, or any features within the Services, to you or to users generally and may not be able to provide you with prior notice. We also retain the right to create limits on your use of said Services and storage at our sole discretion at any time without prior notice to you.
The Services may include advertisements, which may be targeted to the Content or information on the Services, queries made through the Services, or other information. The types and extent of advertising by Put Yourself On on the Services are subject to change. In consideration for Put Yourself On granting you access to and use of the Services, you agree that Put Yourself On and its third party providers and partners may place such advertising on the Services or in connection with the display of Content or information from the Services whether submitted by you or others.
In order to use certain Services, you must become a registered user of the Put Yourself On Site. You agree that Put Yourself On Site user names may be refused, changed, removed or replaced by us for reasons including, but not limited to, using a user name to impersonate another person, if a user name is offensive or violates third party intellectual property, etc . Please note that your user name may be viewed by the public, so you should not choose a user name that personally identifies you.
If you elect to register to use the Services, utilize the Put Yourself On Site and/or participate in any Put Yourself On promotions, you agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the Put Yourself On registration form (such information being the "Registration Data") and (b) maintain and promptly update the Registration Data to keep it accurate. If you provide any information that is untrue, inaccurate, or incomplete, or Put Yourself On has reasonable grounds to suspect that such is the case, Put Yourself On has the right to suspend or terminate your account and refuse any and all current or future use of the Put Yourself On Site and/or Services (or any portion thereof).
In addition to any other Registration Data, to register on the Put Yourself On Site you will be required to choose a password. You are solely responsible for maintaining the confidentiality of any password you may use to access the Services, and agree not to transfer your user name or password, or lend or otherwise transfer your use of or access to the Services, to any third party. In addition, you are responsible for safeguarding the password that you use to access the Services and for any activities or actions under your password. We encourage you to use "strong" passwords (passwords that use a combination of upper and lower case letters, numbers and/or symbols) with your account. Put Yourself On cannot and will not be liable for any loss or damage arising from your failure to comply with the above requirements. You are fully responsible for all activity that occurs in connection with your user name or password. You agree to immediately notify us of any unauthorized use of your user name or password or any other breach of security related to your account or the Services, and to ensure that you "log off" (or exit) from your account (if applicable) at the end of each session. We are not liable for any loss or damage arising from your failure to comply with any of the foregoing obligations.
Upon completion of registration, you will be given your very own profile page, complete with a custom URL to easily share with others (www.putyourselfon.com/yourusername). In addition, certain Registration Data will automatically be pre-populated in your profile page, including, without limitation, your user name (and full name if provided), profile image, the date you registered as a Put Yourself On Site user, your location (if provided), your bio, your talent type or statistical information about yourself, including your age, gender, hair color, eye color, race, weight, height, etc.
You may choose to add information (such as interests, personal description and location) to or delete certain information from your profile page, but your user name and the date you registered as a Put Yourself On Site user, as well as the number of visits to your profile, are required information for your profile page. Your profile page will also automatically display activity and any materials you have uploaded or otherwise submitted via the Services and marked "Public." Please note that your profile page (including any comments that may have been left for you) may be viewed by other users, so you should not include any information in your profile page that you do not want others to see.
All Content, without limitation, including pictures, videos, audio track and blog posts, whether publicly posted or privately transmitted, is the sole responsibility of the person who originated such Content. We may not monitor or control the Content posted via the Services and, we cannot take responsibility for such Content. Any use or reliance on any Content or materials posted via the Services or obtained by you through the Services is at your own risk.
Content that you upload or post, which includes, without limitation, pictures, videos, audio tracks, blog posts, status updates and comments, shall at all times remain your sole and exclusive property. As such, you shall be solely responsible for your videos and the consequences of their posting or publication on or via the Services. Video uploads, like any Submissions (as defined below), are subject to our community standards and conduct policy below.
By submitting, posting or displaying Content on or through the Services, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such Content in any and all media or distribution methods (now known or later developed). You agree that this license includes the right for Put Yourself On to make such Content available to other companies, organizations or individuals who partner with Put Yourself On for the syndication, broadcast, distribution or publication of such Content on other media and services, subject to our terms and conditions for such Content use.
You also grant each user of the Put Yourself On Site and Services a non-exclusive license to access your Submission through the Put Yourself On Site or any other access point authorized by Put Yourself On, and to use, copy, transmit or otherwise distribute, perform, publicly perform, create derivative works of, and display your Submission to the extent expressly authorized by Put Yourself On on the Put Yourself On Site and/or in this TOS. None of the Submissions shall be subject to any obligation of confidence on the part of Put Yourself On, and Put Yourlsef On shall not be liable for any use or disclosure of any Submissions.
We may modify or adapt your Content in order to transmit, display or distribute it over computer networks and in various media and/or make changes to your Content as are necessary to conform and adapt that Content to any requirements or limitations of any networks, devices, services or media.
You are responsible for your use of the Services, for any Content you provide, and for any consequences thereof, including the use of your Content by other users and our third party partners. You understand that your Content may be rebroadcasted by our partners and if you do not have the right to submit Content for such use, it may subject you to liability. Put Yourself On will not be responsible or liable for any use of your Content by Put Yourself On in accordance with these Terms. You represent and warrant that you have all the rights, power and authority necessary to grant the rights granted herein to any Content that you submit.
When you remove or otherwise delete Content from the Services, the licenses granted by you to Put Yourself On and the Put Yourself On Site users shall terminate within a commercially reasonable time. You understand and agree, however, that Put Yourself On may retain (but not display, distribute, or perform) server copies of Content that has been removed or deleted, and that Put Yourself On shall have no obligation to attempt to remove from distribution any of your videos that are otherwise publicly available through the Internet or other publicly accessible medium.
Put Yourself On will terminate a user's access to our Website if, under appropriate circumstances, they are determined to be a repeat infringer.
Put Yourself On reserves the right to decide whether Content or a User Submission is appropriate and complies with these Terms of Service for violations other than copyright infringement, such as, but not limited to, pornography, obscene or defamatory material, or excessive length. We may remove such User Submissions and/or terminate a User's access for uploading such material in violation of these Terms of Service at any time, without prior notice and at its sole discretion.
We reserve the right at all times (but will not have an obligation) to remove or refuse to distribute any Content on the Services and to terminate users or reclaim usernames.
Put Yourself On does not and cannot review all Content or Submissions posted to or created by users accessing the Services (including, but not limited to, the Put Yourself On Site), and is not in any manner responsible for the content of these pictures, videos, audio files, blog posts, status updates, communications, comments or forum postings, or the activities of PutYourselfOn.com users.
We do not endorse, support, represent or guarantee the completeness, truthfulness, accuracy, or reliability of any Content or communications posted via the Services or endorse any opinions expressed via the Services. You understand that by using the Services, you may be exposed to Content that might be offensive, harmful, inaccurate or otherwise inappropriate, or in some cases, postings that have been mislabeled or are otherwise deceptive. Under no circumstances will Put Yourself On be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Services or broadcast elsewhere. Put Yourself On does not permit copyright infringing activities and infringement of intellectual property rights on our Website, and we will remove all Content and User Submissions if properly notified that such Content or User Submission infringes on another's intellectual property rights. Put Yourself On reserves the right to remove Content and User Submissions without prior notice.
Notwithstanding the foregoing, Put Yourself On reserves the right to (i) monitor some, all, or no areas of the profiles, groups, comments and other areas where user generated content will be distributed for adherence to these or other rules that may be published from time to time; and (ii) block or remove Content, Submissions or materials that we determine to be (a) abusive, defamatory, or obscene, (b) fraudulent, deceptive, or misleading; (c) in violation of a copyright, trademark, patent, trade secret, intellectual property or other rights of another or (d) offensive or otherwise unacceptable to Put Yourself On, in our sole discretion.
The amount of storage space and bandwidth per member, in addition to features and/or priveleges may be limited. Accounts may be terminated, suspended, and/or deleted from our system if they remain inactive for a period of one hundred and eighty (180) or more days. In the event of a suspension or deletion of an account, materials (whether audio tracks, videos, still images, forum posts, comments, submissions or other communications) may no longer be accessible.
You agree that Put Yourself On, in our sole and absolute discretion, may terminate your password, account (or any part thereof) or use of the Services, and remove and discard any Submission(s) or other content within the Services, for any reason, including, without limitation, for lack of use or if Put Yourself On believes that you have violated or acted inconsistently with the letter or spirit of the Terms of Service. Put Yourself On may also in its sole discretion and at any time discontinue providing the Services, or any part thereof, with or without notice. You agree that any termination of your access to the Services under any provision of this Terms of Service may be effected without prior notice, and acknowledge and agree that Put Yourself On may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the Services. Further, you agree that Put Yourself On shall not be liable to you or any third-party for any termination of your access to the Services.
The provisions of these Terms of Service pertaining to disclaimers, exclusion of damages, limitations of liability and indemnification shall survive termination.
All rights, title, and interest in and to the Services (excluding Content provided by users) are and will remain the exclusive property of Put Yourself On and our licensors. The Services are protected by copyright, trademark, and other laws of both the United States and foreign countries. Nothing in the Terms gives you a right to use the Put Yourself On name or any of the Put Yourself On trademarks, logos, domain names, and other distinctive brand features. Any feedback, comments, or suggestions you may provide regarding Put Yourself On, or the Services is entirely voluntary and we will be free to use such feedback, comments or suggestions as we see fit and without any obligation to you.
The Put Yourself On name and logo(s) are the exclusive property of Put Yourself On, Inc. or our affiliates. All other trademarks appearing on the Services are trademarks of their respective owners. Our partners or service providers may also have additional proprietary rights in the content which they make available through the Services. The trade names, trademarks and service marks owned by us, whether registered or unregistered, may not be used in connection with any product or service that is not ours, in any manner that is likely to cause confusion. Nothing contained on the Services should be construed as granting, by implication, estoppel or otherwise, any license or right to use any of our trade names, trademarks or service marks without our express prior written consent.
You may not do any of the following while accessing or using the Services: (i) access, tamper with, or use non-public areas of the Services, Put Yourself On's computer systems, or the technical delivery systems of Put Yourself On's providers; (ii) probe, scan, or test the vulnerability of any system or network or breach or circumvent any security or authentication measures; (iii) access or search or attempt to access or search the Services by any means (automated or otherwise) other than through our currently available, published interfaces that are provided by Put Yourself On (and only pursuant to those terms and conditions), unless you have been specifically allowed to do so in a separate agreement with Put Yourself On (NOTE: crawling the Services is permissible if done in accordance with the provisions of the robots.txt file, however, scraping the Services without the prior consent of Put Yourself On is expressly prohibited); (iv) forge any TCP/IP packet header or any part of the header information in any email or posting, or in any way use the Services to send altered, deceptive or false source-identifying information; or (v) interfere with, or disrupt, (or attempt to do so), the access of any user, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, mail-bombing the Services, or by scripting the creation of Content in such a manner as to interfere with or create an undue burden on the Services.
Any information that you provide to Put Yourself On is subject to our Privacy Policy, which governs our collection and use of your information. You understand that through your use of the Services you consent to the collection and use (as set forth in the Privacy Policy) of this information, including the transfer of this information to the United States and/or other countries for storage, processing and use by Put Yourself On. As part of providing you the Services, we may need to provide you with certain communications, such as service announcements and administrative messages. These communications are considered part of the Services and your Put Yourself On account, which you may not be able to opt-out from receiving.
Put Yourself On offers users the ability to create "groups" focused on a particular area of interest, and also offers the ability to make "comments" throughout the Put Yourself On Site, sharing your opinions about others' content or send messages to individual users, as applicable. Groups, comments and other features that support user interaction and communication are to be used for non-commercial use only. You shall not, without Put Yourself On's express written approval, distribute or otherwise publish via any of the Services any material containing any solicitation of funds, promotion, advertising, or solicitation for goods or services.
As with all Services, your privilege to create groups, make comments or participate and/or communicate with other users on Put Yourself On is dependent on your continued compliance with these Terms of Service, specifically including the community standards and conduct policy below. Put Yourself On may revoke your privileges, terminate your registration/account or take any other measures deemed by Put Yourself On to be appropriate, in its sole discretion, to enforce these Terms of Service if violations are brought to our attention. You agree that Put Yourself On may change, remove or replace any group name for any reason. We may refuse to grant you, and you may not use, a Put Yourself On group name that is already being used by someone else; that may be construed as impersonating a company or another person; that belongs to a company or another person; that violates the intellectual property or other rights of any entity or person; that is offensive; or that we reject for any other reason. Please note that group names may be viewed by the public, so you should not choose a group name that personally identifies you, unless that is an option you prefer.
You agree that you are entirely responsible for any Content Submission that you upload, post, email or otherwise transmit to or via the Put Yourself On Site or Services, whether publicly posted or privately transmitted.
You agree to NOT use the Put Yourself On Services (including, without limitation, the Put Yourself On Site) to:
Put Yourself On respects the intellectual property of others, and we ask our users to do the same. Put Yourself On may, in appropriate circumstances and at our discretion, terminate the accounts of users who infringe the intellectual property rights of others. Put Yourself On will remove infringing materials in accordance with the Digital Millennium Copyright Act if properly notified that content infringes copyright. Our DMCA Notifications and Counter-Notifications process is available here, and is hereby incorporated by reference into these Terms of Service.
We will respond to notices of alleged copyright infringement that comply with applicable law and are properly provided to us. If you believe that your Content has been copied in a way that constitutes copyright infringement, please provide us with the following information: (i) a physical or electronic signature of the copyright owner or a person authorized to act on their behalf; (ii) identification of the copyrighted work claimed to have been infringed; (iii) identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material; (iv) your contact information, including your address, telephone number, and an email address; (v) a statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and (vi) a statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
We reserve the right to remove Content alleged to be infringing without prior notice and at our sole discretion. In appropriate circumstances, Put Yourself will also terminate a user's account if the user is determined to be a repeat infringer. Without limiting the foregoing, PUT YOURSELF ON AND OUR PARTNERS DISCLAIM ANY WARRANTIES, EXPRESS OR IMPLIED, OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We make no warranty and disclaim all responsibility and liability for the completeness, accuracy, availability, timeliness, security or reliability of the Services or any content thereon. Put Yourself On will not be responsible or liable for any harm to your computer system, loss of data, or other harm that results from your access to or use of the Services, or any Content. You also agree that Put Yourself On has no responsibility or liability for the deletion of, or the failure to store or to transmit, any Content and other communications maintained by the Services. We make no warranty that the Services will meet your requirements or be available on an uninterrupted, secure, or error-free basis. No advice or information, whether oral or written, obtained from Put Yourself On or through the Services, will create any warranty not expressly made herein.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PUT YOURSELF ON AND OUR SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOOD-WILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES; (iii) ANY CONTENT OBTAINED FROM THE SERVICES; AND (iv) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT PUT YOURSELF ON HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE. IN NO EVENT SHALL PUT YOURSELF ON'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT (INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE), OR OTHERWISE) EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE PUT YOURSELF ON SITE.
You acknowledge and agree that Put Yourself On and our respective parents, subsidiaries, affiliates, successors, assigns, employees, agents, directors, officers and shareholders shall not be responsible or liable for (i) any unauthorized access to or alteration of your Submission; (ii) any Submission sent or received or not sent or received and (iii) any Submission stored on storage devices owned, operated or controlled by Put Yourself On. You acknowledge and agree that Put Yourself On and our respective parents, subsidiaries, affiliates, successors, assigns, employees, agents, directors, officers and shareholders shall not be responsible or liable for any Submission or conduct of any third party, including, but not limited to, content sent using and/or included within the Services provided by any other user of the Put Yourself On Site or any third party licensors or suppliers of Put Yourself On.
EXCLUSIONS: Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you.
YOU ARE ENTIRELY RESPONSIBLE FOR MAINTAINING THE CONFIDENTIALITY OF YOUR PASSWORD AND ANYTHING ELSE ATTACHED TO, OR RELATED TO, ACCOUNT. FURTHERMORE, YOU ARE ENTIRELY RESPONSIBLE FOR ANY AND ALL ACTIVITIES WHICH OCCUR UNDER YOUR ACCOUNT. YOU AGREE TO INDEMNIFY, DEFEND AND HOLD HARMLESS PUT YOURSELF ON, INC, OUR PARENTS, AFFILIATES AND SUBSIDIARY COMPANIES, OFFICERS, DIRECTORS, EMPLOYEES, CONSULTANTS AND AGENTS FROM ANY AND ALL THIRD PARTY CLAIMS, LIABILITY, DAMAGES AND/OR COSTS (INCLUDING, BUT NOT LIMITED TO, ATTORNEYS FEES) ARISING FROM YOUR USE OF THE PUT YOURSELF ON SITE OR SERVICES, YOUR VIOLATION OF THESE TERMS OF SERVICE OR YOUR INFRINGEMENT, OR INFRINGEMENT BY ANY OTHER USER OF YOUR ACCOUNT, OF ANY INTELLECTUAL PROPERTY OR OTHER RIGHT OF ANY PERSON OR ENTITY. YOU AGREE TO IMMEDIATELY NOTIFY PUT YOURSELF ON OF ANY UNAUTHORIZED USE OF YOUR ACCOUNT OR ANY OTHER BREACH OF SECURITY KNOWN TO YOU.
These Terms of Service (and any further rules, policies or guidelines incorporated by reference herein) shall be governed by and construed in accordance with the laws of the State of South Carolina, without giving effect to any principles of conflicts of law, and without application of the Uniform Computer Information Transaction Act or the United Nations Convention of Controls for International Sale of Goods. These Terms, the Put Yourself On Rules and our Privacy Policy are the entire and exclusive agreement between Put Yourself On and you regarding the Services (excluding any services for which you have a separate agreement with Put Yourself On that is explicitly in addition or in place of these Terms), and these Terms supersede and replace any prior agreements between Put Yourself On and you regarding the Services.
The failure of Put Yourself On to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. If the revision, in our sole discretion, is material we will notify you via a website update update or e-mail to the e-mail address associated with your account. By continuing to access or use the Services after those revisions become effective, you agree to be bound by the revised Terms.
